Tuesday June 5th, on KOVC, City Attorney Nick Simonson asked Bob Drake why he didn't ask the Attorney General for an opinion on if City Administrator Dave Johnson broke the law when he created and spread the fake CCI website before last June's city election. Drake said that he couldn't because he is a private citizen and isn't a government official. Simonson told Drake that he is wrong and he could have asked for an opinion from Attorney General. So who is right??
The following is from the Attorney General's web site:
State law restricts who may request and receive an Attorney General's Opinion. The Attorney General may issue opinions only to state agencies and officials, the state legislature, county state's attorneys, certain city officials, water resource boards, soil conservation districts, health district boards, the Judicial Conduct Commission, and the Garrison Diversion Conservancy District.
